1. Definitions

In these terms: Cuego: the provider of this platform, established in the Netherlands. Customer: the natural or legal person who enters into an agreement with Cuego. Services: the SaaS solutions offered by Cuego, including but not limited to AI chatbot, CRM, ticketing and communication tools.

2. Applicability

These terms and conditions apply to all offers, quotes and agreements between Cuego and the Customer. By using our Services you agree to these terms.

3. Service provision

Cuego provides a cloud-based platform for customer management. We aim for 99.9% availability per year, excluding planned maintenance. We reserve the right to modify or expand the Services, provided this does not negatively affect core functionality.

4. Subscriptions and payment

Subscriptions are entered into for the chosen period (monthly or annually). Invoicing is done in advance. In the event of late payment we reserve the right to suspend access to the Services after a reminder period of 14 days.

5. Intellectual property

All intellectual property rights in the Services rest with Cuego. The Customer obtains a non-exclusive, non-transferable right of use for the duration of the agreement. Data entered by the Customer remains the property of the Customer.

6. Liability

Cuego's liability is limited to direct damages and shall never exceed the amount paid by the Customer to Cuego in the 12 months prior to the event causing the damage. Cuego is not liable for indirect damages, consequential damages or lost profits.

7. Cancellation

Monthly subscriptions can be cancelled at any time with effect from the next billing period. Annual subscriptions can be cancelled with a notice period of 30 days before the end of the contract period.

8. Governing law

These terms are governed by Dutch law. Disputes will be submitted to the competent court in the district where Cuego is established.
